2016

Things first got shaky way back in 2016. The federal DEA announced its plans to slap a nationwide ban on kratom. This would make it illegal everywhere, including right here in the Cornhusker State. That really spooked the community that used this plant.

People across the whole country raised their voices. There was massive public pushback, petitions, and calls to lawmakers. The DEA listened and backed down. The federal ban was canceled. Nebraskans were relieved as things went back to how they were.

2019

In 2019, lawmakers decided safety is better than prohibition. They wanted to pass a version of the Kratom Consumer Protection Act (KCPA) that comprised rules for testing and labeling to keep it away from kids. This was a positive step towards responsibility. But when the bill reached the committee, it ran out of steam and faded away. Kratom stayed legal and unregulated in Nebraska.

2024

Things took a turn for the worse in 2024. Legislative Bill 972 came about. It would add kratom to Nebraska’s official list of controlled substances. If it passed, kratom would have been completely illegal to possess or sell.

Panic spread among kratom lovers. Nebraskans and advocacy groups like the American Kratom Association (AKA) were furious. They reached out to senators to share their perspective and argued fiercely against this unreasonable bill. Because of the resistance, lawmakers postponed LB972 indefinitely.

2025

Kratom was still legal in Nebraska, but not without a final test. In early 2025, yet again, the government tried to ban kratom. They introduced Legislative Bill 431 to make kratom a Schedule I controlled substance—the strictest category, mandating a full ban. It was nothing short of déjà vu! Once more, advocates and users rallied.

Nebraska’s Legislature realized bans were not going to work. So they decided to regulate kratom. They put forward Legislative Bill 230. It was the state’s own Kratom Consumer Protection Act. Unlike earlier bills that never saw the light of day, LB230 won approval. And the governor signed it into law on May 15, 2025.

Present Kratom Laws In Nebraska

Marketing and labeling rules: Kratom products can’t have cartoons or be packaged to look like candy to entice kids. Marketing attempts should be aimed at adults. Every package must also clearly say that kratom isn’t recommended for pregnant or breastfeeding women.

Strict testing standards: Extract, capsule, or powder kratom products sold legally in Nebraska must undergo independent lab tests. This checks for heavy metals, salmonella, and other dangerous additives. It also makes sure the product isn’t too strong (limits on 7-OH alkaloid).

Vendor guidelines: Sellers and processors must register with Nebraska’s health department. It adds a layer of accountability. They need to sell strictly to adults while making sure their products don’t exceed 2% of the potent alkaloid 7-hydroxymitragynine.
