That proposal, if passed, would have banned kratom overnight. 

But groups like the American Kratom Association and the Botanical Education Alliance were not about to take this lying down. They insisted that legislators pull mitragynine from the bill before it passed. They did. And kratom laws in Maine kept kratom legal, at least for the time being.

2019

Things began to stir again in 2019 when lawmakers introduced a Kratom Consumer Protection Act (KCPA) to regulate testing, labeling, and safety standards—basically, trying to make kratom safer for consumers. It was a step up from a complete ban. But after a lot of debate, that bill stalled in committee. It never became law, which means kratom remained legal in Maine.

2021

Between 2021 and 2023, Maine’s Department of Health and Human Services (DHHS) stepped in with a different approach. Instead of passing new laws, DHHS launched public education campaigns. They handed out flyers, hosted online discussions, and urged folks to stay informed about kratom’s risks and responsible use. Consumers’ well-being was in their own hands.
